South Carolina has a mandatory videotaping statute requiring law enforcement to provide video footage of certain parts of a DUI investigation. When introduced, the law was the only one of its kind in the country.
If officers cannot provide the required recording, the consequences for the prosecution can be significant. A failure to comply with the videotaping requirement may provide grounds for dismissal of the DUI case.
